Terms & Conditions and Acceptable Use Policy By using Link All Network Solutions web/email hosting services, you agree to comply with our policies. You are expected to use the internet with respect, courtesy, and responsibility, giving due regard to the rights of other internet users. Payment Policies and Fees All accounts are set up on a pre-pay basis. Prepayment is due each anniversary (one month, two months etc.) following the date the account was established. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. Billing will continue until you cancel your hosting account. Additional features can be added at any time. Link All Network Solutions reserves the right to change prices at any time. It is a violation for you to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, and/or electronic checks. A determination of such misuse or fraudulent use shall be in Link All Network Solutions 's sole discretion. Link All Network Solutions shall report, and you shall waive all rights to privacy, to the extent permitted by law, all such misuses and fraudulent uses as determined by Link All Network Solutions in its sole discretion to appropriate government authorities, credit reporting services, financial institutions and credit card companies. Cancellation and Refunds You may cancel at anytime by sending email to billing@linkall.net. A reason for cancellation is requested. Phone requests will not constitute acceptance of any cancellation. Notification of cancellation must be received at least five business days prior to your cycle date, with the cycle date being the day of the month you sign up, in order to avoid charges in full for the next cycle. We would give refunds for full months unused if you want to cancel prepaid service. Hosting time that already expended, domain registration fees and setup fees are non-refundable. We also do not give partial months refunds (no refunds for the current month in use). There will be no refund if cancellation is done by Link All Network Solutions due to restrictions violation. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Link All Network Solutions by fax, email, or mail for cancellation of services. Link All Network Solutions reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and returned. Any violation of policies which results in extra costs will be billed to the customer (i.e. reconfiguration of server, etc.) Uptime Guarantee If our servers are not up 99.9% of the time during your first 30 days of hosting we will gladly refund your hosting fees and cancel your account. Just follow our cancellation instructions and send us cancellation notice by email to billing@linkall.net. Be sure and mention that you would like a refund based on our 99.9% Uptime Guarantee. Specific Acceptable and Prohibited Use Polices Content Policy All services provided by Link All Network Solutions may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright (including MP3s), trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat. All pornographic content and sex-related merchandising is prohibited on all Link All Network Solutions servers, whether legal or illegal. This includes sites that may infer sexual content or links to adult content elsewhere. In addition, sites containing profanity or vulgar language are also prohibited. The subscriber agrees to indemnify and hold harmless Link All Network Solutions from any claims resulting from the use of the service that damages the subscriber or any other party. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Link All Network Solutions servers or any other server on the internet. Links to such materials are also prohibited. Link All Network Solutions will be the sole arbiter as to what constitutes a violation of these provisions Spamming Sending unsolicited email, including, without limitation, commercial advertising and informational announcements, mail bombing, subscribing someone else to a mailing list without that person’s permission is strictly prohibited. Spamming, trolling, or cross-posting articles to an excessive number of newsgroups is considered as net abuse. Link All Network Solutions will immediately terminate, without any warning, the account of any Member who conducts these activities. Misuse of System Resources It is a violation for anyone who, including but not limited to, Attempting without authorization to enter into a secured computer system (Hacking or otherwise altering of a site owned and operated by another person), employs posts or programs which consume excessive CPU time or storage space, permits the use of mail services, mail forwarding capabilities, POP accounts, or auto responders other than for their own account; or resale of access to CGI scripts installed on our servers. Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation or service to other Web Site Source customers. You will be notified in 24 hours about offending CGI script. No chat room or similar scripts allowed. Consequences of Violation Link All Network Solutions will initiate an investigation of an alleged violation of these term and condition. Link All Network Solutions may restrict Customer's access during the investigation in order to prevent further possible unauthorized activity. Link All Network Solutions may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies (depending on the severity of the violation). Link All Network Solutions will notify the appropriate law enforcement department or agency of such violation if such violation is a criminal offense Link All Network Solutions does not issue service credits for any outages incurred through service disablement resulting from Policy violations. Privacy Statement Link All Network Solutions will not disclose or distribute your information to or with any third parties, for whichever purpose it may be. Any e-mail and private information collected is never sold to anyone and remains private. Interpretation Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited. Link All Network Solutions reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill. Common sense is the best guide as to what is considered acceptable use. The following are examples of unacceptable uses: Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of export restrictions, harassment, post defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights, fraud, trafficking in obscene material, drug dealing, and other illegal activities. Log Files Log files will be deleted on a periodic basis. Users are responsible for downloading their log files. It is recommended that clients who wish to maintain a history of their log files download them monthly. Limitation of Liability Link All Network Solutions does not guarantee that our services will be uninterrupted and will not be held liable for any claims resulting from the use or the inability to use Link All Network Solutions services including, but not limited to, service interruptions, Internet connectivity problems, unauthorized access to Link All Network Solutions servers, domain name registrar problems, DNS caching, Internet bandwidth congestion, power failures and natural disasters. Link All Network Solutions shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Link All Network Solutions’s servers going off-line or being unavailable for any reasons or also resulting from the corruption or deletion of any web site from one of Link All Network Solutions's servers. All damages shall be limited to the immediate termination of service. Modification Note that these terms and conditions may change from time to time and it is your responsibility to check for such updates Link All Network Solutions reserves the right to add, delete, or modify any provision of this Policy at any time without notice. Reporting Network Abuse Any party seeking to report any violations of Link All Network Solutions’s policy may contact us via e-mail: abuse@linkall.net Failure to follow any term or condition will be grounds for immediate account deactivation. |
